b. Approval of Ordinances on Second Reading.

i. Council Bill No. 33, approving an Intergovernmental Agreement authorizing a memorandum of Understanding for the City of Englewood’s participation in the Denver Metro Auto Theft Team.
 
ii. Council Bill No. 34, approving an intergovernmental Agreement authorizing a Memorandum of Understanding with the United States Marshals Service for the City of Englewood’s participation in the Adam Walsh task Force

11. Ordinances, Resolutions and Motions

a. Approval of Ordinances on First Reading.

i. Council Bill No. 35, an emergency bill for an ordinance establishing a temporary suspension or moratorium on the establishment of new medical marijuana dispensing and growing uses for a period of six months.

i. Recommendation from the Human Resources Department to adopt a resolution approving a Memorandum of Understanding amending the Collective Bargaining agreement between the Englewood Firefighters association and the City of Englewood for 2009-2011.

ii. Recommendation from the Littleton/Englewood Wastewater treatment plant to approve, by motion, the purchase of one new ten-yard dump truck.  Staff recommends awarding the contract to Transwest Trucks in the amount of $99,746, piggybacking on the city of Rifle’s contract.

Council Member John Moore additional comments
Additional comments provided by Council member John Moore, explaining that council members on not free to excuse your self from a vote unless council unanimously votes to excuse a member from voting.

This is simply not the case, and John Moore is clearly mistaken.  If there is a moral or financial involvement to not vote on a specific matter, it is the responsibility of the member voting to excuse themselves from the vote.  There is no requirement forcing one member of council to vote on a matter.  Especially considering that Jim Woodward and Jill Wilson are involved with the Englewood Unleashed organization, it would only be the proper and moral action to abstain and remove themselves from the vote.
